Minimum wage - France

SIPSI

On January 1th 2017, the use of the online registration system called “SIPSI” will be mandatory for non-French companies. All the data regarding the Loi Macron or French minimum wage, will be stored here electronically. Eventually, it should be possible to generate attestations with this system, because all the employees must be registered in this system with all their personal data. Employees with existing paper attestations don’t have to be put in the system yet if their attestation is not yet expired. Their attestation will remain valid until the expiry date.

What do I do?

Step 1 (January)

In this month, you will create an SIPSI account and will send us the username and password so we will have access as the representative.

For customers with a paper attestation with an expiry date until 30-06-2017; your papers will remain valid until the expiry date ends, but be sure to have the driver(s) filled in before the date passes. The driver no longer needs the Certificate FR. It is however important that you create an account on the “SIPSI” system within the following month. After registering, you will receive a username and password. You will need to send those to us so we can fill in the representative.

Step 2 (February)
You make the choice to fill in the drivers yourself or you will leave it to Transport in Nood for a fee that is yet to be decided on.

Stap 3 (March)
Check all your data in SIPSI well and your attestations can be generated.

Italy

There is news from Italy on the new minimum wage law. As of yet, this is only for drivers that are driving cabotage in Italy, so loading and offloading must be done.

They must be registered to the Italian government since the 26th of December 2016.

Austria

The Austrian authorities have brought out the following:

Every ride (international and cabotage) to Austria must be announced in the following multi-lingual portal: www4.formularservice.gv.at
An Austrian representative in not needed for the transportation sector. This sector is the only one with an exception.
Drivers must carry the following documentation:
A. Notification of employee posting to Austria (you can get a copy of the registration made in the portal above)
B. Vehicle license plate numbers must be registered for entering Austria.
C. Employment contract (translated to English or German)
D. Payslips (translated to German)
E. Proof of wage payment (translated to German)
F. A1 document evidencing social insurance (translated to German)
Documents may be stored electronically (including on a tablet). The driver must be able to show these to the authorities during a control. The company is not permitted to send this documentation to the authorities during a control; the driver must have them in advance.

Sanctions

Failure to carry the required documents in the vehicle: €1.000 - €10.000
(Repeat offence: €2.000 - €20.000).
Not paying the Austrian minimum wage: €1.000 - €10.000.
Not making the online notification: €1.000 - €10.000 (Repeat offence: €2000 - €20.000).
Not carrying the online notification in the truck: €500 - €5.000 (Repeat offence: €1.000 - €10.000).
If the notification should be changed, but the company fails to do this: €41 - €4.140.
